Terms and Conditions of Business for Access Irrigation Limited
(hereinafter known as A.I.L.)

Prices
All prices quoted are exclusive of V.A.T. and are subject to the prevailing rate of V.A.T. at the date of invoice.
All prices quoted are exclusive of carriage charges, except where stated otherwise.

Payment
For ‘Supply Only’ orders or orders being installed by an ‘Approved Contractor’, AIL require full payment with order.
For A.I.L. credit account Customers, invoices for goods are payable by 20th month following despatch.
For ‘Assisted Install’ projects, the parts will be supplied and invoiced at the commencement of the project, along with any design fees applicable.
A.I.L. require payment for the materials before despatch.
The installation and Supervisory visits will be invoiced at the completion of the job or monthly as applicable.
No goods are supplied on a ‘sale or return’ basis.

Delivery
All dates given by A.I.L. are estimated dates only and therefore A.I.L. shall incur no liability for any loss or damage whatsoever as a result of a failure to adhere to any such dates.
A.I.L. shall be entitled to make partial deliveries, invoice for goods delivered and expect payment in accordance with their terms of payment.
Unless the Customer informs A.I.L. of alternative delivery arrangements, goods will normally be despatched by 3 day delivery service.
Any changes to these delivery arrangements such as A.M. delivery costs will be borne by the Customer.
All goods supplied for destinations outside of the United Kingdom are sold ex-works.
Acceptance by the carrier on behalf of the Customer shall constitute delivery of the goods and insurance and risk liability shall pass to the Customer at this point.
The Customer is obliged to accept delivery of goods.
Where re-delivery is required, A.I.L. reserves the right to pass any additional charges on to the Customer.
It is the Customers responsibility to inform A.I.L. of any short delivered or damaged goods.
This must be done in writing within 5 working days.

Installation Projects
A.I.L. will despatch all the materials, usually within two weeks of receiving a written order.
The order may be delivered in a number of consignments.
For large projects, for an additional charge, the materials may be supplied in stages as the project progresses - payment before despatch is required at each stage.

Re-stocking Charges
A re-stocking charge will be levied on stock items ordered but returned through no fault of the goods or the Company.
No goods will be accepted without authorisation from A.I.L. and accompanied by an A.I.L. returns form, obtainable from the Sales Department.
The re-stocking charge will be 15% of the value of the goods returned (subject to a minimum charge).
Non stock items will only be accepted subject to agreement with suppliers and may be subject to higher charges.

Warranty
A.I.L. warrants that all goods supplied are to the best of their knowledge of merchantable quality and are free of any defects due to materials, design or workmanship.
A.I.L. total liability is limited to the replacement or value of the specific goods.
The method of settlement of any claim is at the discretion of A.I.L.
A.I.L. reserves the right to substitute any goods with those of similar quality if the original is unavailable.
All materials and workmanship are guaranteed for a period of twelve months from the date of invoice.
A.I.L. basic goods warranty is a return to base warranty.
The Customer is responsible for sending the goods back to A.I.L. for inspection.
Faulty goods will be replaced or repaired as applicable and returned to the Customer at A.I.L. expense.
An inspection charge will be levied on returned goods that have no fault.
If replacements are required before goods are returned for inspection, then the replacements will be despatched and invoiced.
This invoice will be credited if the returned goods are subsequently found to be faulty.
Returned goods for whatever reason will only be accepted with authorisation from A.I.L. and accompanied with a Returns Form.
All goods should be sent on a signed for service.
Warranty returns will normally be inspected within 7 working days.

Risk & Title
Risk and therefore responsibility for insurance of all items supplied shall pass to the Customer upon delivery within the UK.
Title of items supplied by A.I.L. does not pass until all outstanding amounts due are settled in full.
